When considering purchasing real estate, be sure to have inspections conducted to protect your interests whether the lender you may choose requires them or not. For example, in purchasing real estate you may want to have a home inspection conducted or an updated survey of the plot to make sure that there are no surprises in these areas after the purchase is completed. Whether a warranty deed, special warranty deed, or quitclaim deed is executed will determine what covenants are being conveyed with the instrument from the seller to the buyer in a real estate sale. As is the case in most legal matters, it is always better to approach real estate transactions in a preventative manner to avoid expense and headaches later.
Some of the most common lawsuits regarding land that we see in our office are adverse possession suits, tax sale confirmations, partition (land division) cases, and land line disputes. When determining whether to pursue such a suit or not, there may be other costs involved that need to be considered such as the expense of surveyors, engineers, appraisers, and land commissioners.
